Case T-58/23 – McDonald’s International Property Co. Ltd (‘McDonald’s’) v. Supermac’s (Holdings) Ltd (‘Supermac’s’) – action for revocation for non use of EU TM Registration No. 62638 ‚BIG MAC‘
The latest ruling from the EUIPO showed that McDonald’s EU registration for BIG MAC should be revoked for non-use in relation to chicken sandwiches or foods prepared from poultry products.
The case shows that even famous trade marks may be revoked if the proprietor does not file sufficient evidence to support their registration.
